Welcome to MileageBuddy. These Terms of Service ("Terms") govern your use of the MileageBuddy mobile application ("App") and related services provided by MileageBuddy ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using MileageBuddy, you confirm that you:

• Are at least 18 years old or have parental/guardian consent
• Have the legal capacity to enter into these Terms
• Will comply with all applicable laws and regulations

If you do not agree to these Terms, do not use the App.

2. Description of Service

MileageBuddy is a mileage tracking application that allows users to:

• Track vehicle trips using GPS location services
• Categorize trips for business, personal, medical, or charitable purposes
• Generate mileage reports for tax deduction purposes
• Export trip data in various formats

The App is designed as a tool to assist with mileage record-keeping. It is not a substitute for professional tax, legal, or accounting advice.

3. Account Registration

3.1 Account Creation

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at support@mileagebuddy.app if you suspect unauthorized access to your account.

4. Subscriptions and Payments

4.1 Subscription Plans

MileageBuddy offers subscription-based premium features. Subscription details, pricing, and features are displayed within the App.

4.2 Billing

• Subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account upon purchase confirmation
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial subscription periods.

4.4 Price Changes

We reserve the right to modify subscription pricing. Any price changes will be communicated in advance and will apply to subsequent billing cycles.

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App to transmit malicious code or interfere with its operation
• Not create multiple accounts to abuse free trials or promotional offers
• Ensure your device meets minimum system requirements
• Not use the App while operating a vehicle in a manner that compromises safety

6. Location Services

6.1 GPS Tracking

The App requires access to your device's location services to function. By using the App, you consent to GPS tracking during trip recording.

6.2 Background Location

The App may access your location in the background to track trips accurately. You can manage location permissions in your device settings at any time.

6.3 Accuracy Disclaimer

GPS accuracy depends on various factors including device hardware, environmental conditions, and satellite availability. We do not guarantee the absolute accuracy of distance calculations.

7. Data and Content

7.1 Your Data

You retain ownership of all trip data and personal information you provide. By using the App, you grant us a limited license to process this data solely to provide our services.

7.2 Data Storage

Trip data is stored locally on your device. For details on data handling, please refer to our Privacy Policy.

7.3 Data Export

You may export your trip data at any time through the App's export features.

7.4 Data Loss

While we implement reasonable safeguards, we are not responsible for data loss resulting from device failure, user error, or circumstances beyond our control. We recommend regularly exporting your data as a backup.

8. Intellectual Property

8.1 Our Rights

The App, including its design, features, code, graphics, and content, is owned by MileageBuddy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

8.2 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation or compensation to you.

9. Disclaimers

9.1 "As Is" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Tax and Legal Disclaimer

MileageBuddy is a record-keeping tool only. We do not provide tax, legal, or accounting advice. The accuracy of mileage deductions depends on proper categorization and compliance with applicable tax laws. Consult a qualified professional for tax guidance.

9.3 No Guarantee

We do not guarantee that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• Results obtained from using the App will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILEAGEBUDDY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Any damages arising from your use or inability to use the App

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless MileageBuddy and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

12.1 By You

You may stop using the App and delete your account at any time.

12.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms.

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will remain in effect.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through:

• In-app notifications
• Email to registered users
• Updates posted on our website

Continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

14.1 Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MileageBuddy regarding the App.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
